Terms of Service

1. Service provider

In these Terms, Synapsia S.r.l. is also referred to as Synapsia, we or our; anyone who uses Agape is referred to as the user.

2. Agape service

Agape is an artificial intelligence service that assists users with everyday activities, writing, study, work, understanding documents, research, organisation and content generation. It also includes features dedicated to the Catholic faith, such as consultation of Scripture and sources, prayers, the Rosary, Lectio Divina, Novenas, the liturgical calendar and spiritual content.

Features, limits, availability, artificial intelligence systems and sources may evolve. Any future Community or other public or shared areas are not covered by these Terms until they are activated under dedicated rules.

To provide certain features, Agape may use third-party artificial intelligence models, infrastructure and services, including through APIs. The provider or model used may vary depending on the feature, availability, quality and security requirements of the service. Information on the processing of personal data by technical providers is described in the Agape Privacy Notice.

3. Nature of artificial intelligence

The user is always informed that they are interacting with an artificial intelligence system. Agape generates or processes content on the basis of the request, context and available sources. Even when it cites sources, it may produce errors, omissions, inaccurate interpretations or outdated responses.

Outputs do not constitute decisions of the Company or professional advice. The user must verify relevant information before relying on or using it, especially where it may affect health, safety, rights, money, work, education or other people.

4. Catholic perspective and spiritual limitations

Agape may offer a Catholic perspective where relevant, distinguishing, as far as reasonably possible, between official texts, quotations, paraphrases, theological interpretations and generated content. The technology service is independent. Unless expressly stated otherwise, Agape is not an official instrument of, nor is it approved, sponsored or operated by, the Holy See, the Italian Episcopal Conference, any diocese, parish or other religious authority.

Agape does not administer sacraments, grant absolution, provide personal spiritual direction or replace a priest, community, spiritual adviser or human relationship. For important doctrinal or pastoral matters, the user is encouraged to consult official sources and a competent person.

5. Age and legal capacity requirements

To create an account and use Agape independently, the user must be at least 18 years old. Anyone under the age of 18 may not register for or independently use the service. Synapsia may request reasonable age verification and suspend or close non-compliant accounts.

6. Account and security

The user must:

• provide accurate information and keep it up to date where necessary
• keep credentials and devices secure and confidential and not share the account
• promptly inform Synapsia in the event of unauthorised access
• not create accounts using another person's identity or to circumvent suspensions or limits
• export or save any content the user wishes to retain before closing the account

The user is responsible for activities carried out through their account until unauthorised use is reported, except where mandatory law provides otherwise.

7. Free plan and premium plans

Agape may offer a free plan with usage limits and one or more premium plans. Before purchase, the total price, taxes, duration, included features, limits, billing frequency and whether automatic renewal applies are displayed.

If a plan provides for automatic renewal, the subscription renews for the period indicated at checkout until cancelled. Cancellation stops future renewals and normally leaves the plan active until the end of the period already paid for. No refunds are due for partially used periods, except where the user has a right of withdrawal, the service is non-conforming, a charge was made in error, or another mandatory right applies.

Purchases made through the Apple App Store, Google Play or another intermediary may be billed and refunded under the intermediary's rules, without prejudice to mandatory consumer protections. Synapsia does not store full payment card details.

Consumers retain, in all cases, the rights arising from the statutory guarantee of conformity applicable to digital content and digital services under applicable law, including the remedies available in the event of lack of conformity.

8. Consumer right of withdrawal

A consumer who purchases at a distance has the right to withdraw from the contract within 14 days of its conclusion, subject to the exceptions provided by law. Instructions and the channel for exercising this right are provided at checkout or in the order confirmation.

If the user requests immediate activation of the service during the withdrawal period, Agape collects the declarations required by applicable law. If the user withdraws after performance of the service has begun, proportionate charges or the exceptions applicable to services and digital content may apply. Rights arising from lack of conformity of the digital service remain unaffected.

9. User content

The user retains their rights in content they enter or upload. By submitting content, the user grants Synapsia a limited, non-exclusive licence, valid for the time necessary to host, reproduce, convert, transmit and process the content, directly or through appointed technical providers, solely to provide Agape, protect the service and comply with legal obligations.

To provide certain features, prompts, files, portions of context and other strictly necessary content may be transmitted to and processed by third-party providers of artificial intelligence models, infrastructure or services. Synapsia selects and configures the services used in production so that, under the terms applicable to the selected service, user content is not used to train or generally improve the provider's models, unless the user gives a separate and specific consent or opt-in. Further information on providers, purposes, retention periods and any data transfers is contained in the Privacy Notice.

The user represents that they hold the rights and authorisations necessary for the content and that it does not infringe the privacy, intellectual property, confidentiality, image rights or other rights of third parties. The user should avoid providing unnecessary personal data and must not use Agape as the primary or sole repository for important documents.

10. Outputs and generated content

To the extent permitted by law and third-party rights, the user may use outputs generated for them. Outputs may not be unique: similar requests from different users may produce similar results. Synapsia does not guarantee that an output is protected by copyright, free from third-party rights or suitable for a particular purpose.

In the cases and within the timeframes required by applicable law, Agape adopts technical measures to ensure that synthetic outputs generated by the system are marked in a machine-readable format and are detectable as artificially generated or manipulated, subject to technical feasibility and any exceptions provided by law. The user must not remove such indicators where the law requires them to be retained and must disclose the artificial origin of published content where required by Regulation (EU) 2024/1689 or other applicable laws.

11. Permitted use

The user may use Agape for lawful personal or professional purposes, in compliance with these Terms, the service documentation and the rights of others.

12. Prohibited uses

The user must not:

• violate laws, fundamental rights, intellectual property rights, confidentiality obligations or the secrets of others
• generate, distribute or facilitate unlawful, fraudulent, threatening, discriminatory, sexually abusive, exploitative or dangerous content
• upload criminal-record, health, intimate or minors' data relating to third parties without an appropriate legal basis and strict necessity
• impersonate individuals or religious authorities, create false endorsements or present Agape as an official source of the Church
• use outputs as the sole basis for diagnoses, treatments, legal, financial, safety-related or other high-impact decisions
• circumvent technical limits, attempt unauthorised access, introduce malware or compromise the service
• carry out scraping, mass automation, resale, systematic competitive benchmarking or benchmarking intended to reproduce the service, or systematic extraction, without written authorisation; decompile, disassemble or reconstruct the code or systems, except to the extent mandatorily permitted by law
• use Agape to train competing models or create datasets from outputs in violation of the rights of Synapsia or third parties

13. Health, emergencies and crisis situations

Agape is not a medical, psychological, legal, financial or emergency service. If a person is in immediate danger, or fears they may harm themselves or others, they must immediately contact the local emergency number, which is 112 in Italy, or seek help from a professional or a trusted person who is physically present. They should not wait for a response from Agape.

14. Agape intellectual property

The software, interface, trademarks, graphics, databases, selection and organisation of sources, proprietary texts and service components belong to Synapsia or their respective licensors. The user is granted a personal, limited, revocable, non-exclusive and non-transferable licence to use the service while the account remains valid.

Texts from Scripture, the Magisterium, the Catechism, prayers and other sources remain subject to the rights and terms applicable to their respective sources. Their inclusion in Agape does not transfer those rights to the user or to Synapsia.

15. Availability, changes and maintenance

Synapsia aims to keep Agape available and secure but does not guarantee uninterrupted or error-free operation. The service may be suspended for maintenance, security, updates, provider failures, force majeure or legal obligations. Where reasonably possible, planned or significant interruptions are communicated in advance.

Free features may be modified or removed. Material changes to a premium plan are communicated with reasonable notice; consumers retain all mandatory remedies applicable to digital services.

16. Suspension and termination

The user may request account closure through the settings or via the channel indicated in the service. Account closure does not cancel payment obligations already accrued and does not replace cancellation of a subscription through an app store where the purchase is managed by that provider.

Synapsia may restrict, suspend or close an account in the event of a serious or repeated breach of these Terms, risk to users or systems, fraud, non-payment, an order from an authority or a legal requirement. Except in urgent cases or where prohibited by law, Synapsia provides reasons and a reasonable opportunity to challenge the decision.

17. Warranties and liability

All warranties and liabilities that cannot be excluded in relation to consumers remain unaffected. To the extent permitted by law, Agape is provided subject to technical availability and Synapsia does not guarantee the accuracy, completeness, uniqueness or fitness of outputs for a particular purpose.

Synapsia is not liable for decisions taken without reasonable verification of an output, prohibited uses, content provided by the user, third-party services or events outside its reasonable control. No provision limits liability for wilful misconduct or gross negligence, personal injury, breach of mandatory obligations or any other liability that cannot be limited by law.

For users acting in the course of a business or professional activity, and only to the extent permitted by law, Synapsia's total liability in connection with the service is limited to the amount paid by the user for Agape during the twelve months preceding the event giving rise to liability. This limitation does not apply to consumers and does not apply in cases of wilful misconduct, gross negligence, personal injury, breach of mandatory obligations or any other liability that cannot be limited by law.

18. Privacy

The processing of personal data is described in the Agape Privacy Notice and Cookie Policy. Any explicit consent required for data revealing religious beliefs is separate from acceptance of these Terms and may be withdrawn in accordance with the Privacy Notice. Not giving that consent, or withdrawing it, does not prevent use of the service.

19. Communications, complaints and support

Contractual communications may be sent to the email address associated with the account or displayed in the app. The user must keep their email address up to date. Support requests and complaints may be sent to support@agapeai.io; legal communications to legal@agapeai.io; and requests relating to personal data protection to privacy@agapeai.io. Where relevant, communications should identify the account concerned and provide a clear description of the issue.

Consumers may also use alternative dispute resolution bodies available under the law of their country, without giving up their right to bring proceedings before the competent court.

20. Governing law and jurisdiction

These Terms are governed by Italian law. If the user is a consumer resident in another country, any mandatory protections under the law of that country and any jurisdiction required by mandatory rules remain applicable, including, as a general rule, the courts of the consumer's place of residence or domicile.

For users acting in the course of a business or professional activity, any dispute is subject to the exclusive jurisdiction of the Court of Perugia, unless otherwise required by mandatory law.

21. Changes to these Terms

Synapsia may update these Terms to reflect regulatory, technical or service changes. Material changes are communicated with reasonable notice and do not operate retroactively to the user's detriment. If the user does not accept the changes, they may stop using the service and cancel renewal before the changes take effect, without prejudice to protections provided by law.

22. Final provisions

If any provision is invalid or unenforceable, the remaining provisions remain in force. Failure to exercise a right does not constitute a waiver. Synapsia may transfer the contract as part of a reorganisation or transfer of the service, subject to consumer rights and appropriate information where required.
